Malcolm Metcalfe
Animal welfare offences *
Sentence
6 months imprisonment suspended for 24 months, disqualified from keeping sheep for 5 years, £1778.01 costs, £154.00 surcharge
East Riding of Yorkshire Council Animal Health Officers involved with Malcolm Metcalfe since 2021 due to concerns about high mortality and failures to remove carcasses. On July 8, 2024, APHA alerted council of dead sheep on land at Hutton. Visits from July 9 to September 3, 2024, revealed ongoing failures to remove carcasses, decomposing remains, recumbent sheep, and inadequate access to water. ABP disposal notice served July 12, 2024; further notices under Animal Welfare Act on July 19, 2024, requiring veterinary investigation into high mortality and increased stock inspections. Despite notices, issues persisted. Post-mortem on lamb showed severe parasitic gastroenteritis; vet noted competent stockkeeper should have acted sooner. Multiple unconfirmed sheep movements on national database.
Pleaded guilty to eight animal health and welfare offences. Magistrates noted prolonged and repeated incidents of cruelty and ill-treatment of animals in a commercial context. Passed custody threshold but suspended to prevent future offending. Barrister cited health issues, sorrow, and that sheep farming was his only income source; now recognizes inability to keep sheep, with sheep transferred to sister.
